Will this charge stick? Getting gay in public?

Me and my friend have been sort of seeing each other and hanging out alot.. So, we were at the park in this small neighboring town we live in and we went for a hike... Well, we started fooling ( feeling each other up ) around in this area where there are alot of rocks or boulders and we didnt think anyone was around.. So, all the sudden I was giving him a BLANK and this cop comes out of no-where and grabs me from behind and throws me on the ground in the mud.. And, threw a flashlight at my friends head... So, the town doesnt have a statute for and we were charged with indecent exposure and " getting gay in public " Shouldnt it just be indecent exposure? Cop said, he threw that in for good measure and it made the town newspaper and I am very embarred. How can they have a charge called: Getting Gay in Public??
